    Do not take that snipet out of context..Innovation, research and development, that you have talked about was in the past.Do you know that Boeing has a R & D Lab in bangalore?So does many globals..They are already doing modelling and simulation at those centers :).When they made it difficult for innovators to get here..jobs left US to go to innovators...Same will happen with Technology soon :)

    By the way, all those your points are valid but will have a negligable impact on Housing market or economy in short term..atleast until next cycle..Unless US reform immigration policies for a 21st century knowledge revolution..create well paid jobs for best and brightest in the world right here..who can earn, spend and not borrow..(EB category) ...Housing problem will also resolved...But US is lagging way behind.this is my opinion as Obama Administration has not thought so far beyond providing food coupons, housing rescue and medicare...Based on what is on the card, there will be lot of blue collar folks...nothing on innovation and technology and more Family based immigrants on welfare and low paid jobs...Do you still think, thing of past holds good now?

    I think he knows quite a bit about the immigration rules.He raised a point that it is merely a guidance.What it means that it can be contested and challenged...unlike if it were a law.

    Whoever the president is - Obama or McCain - our/EB immigrants fate is more in the hands of congress.

    I was just watching the outcome of financial bailout bill - it failed in the house despite having the support of current president and two presidential candidates.This is about the much hyped out bailout plan - the outcome of this bill for sure affects pretty much every american - this bill failed in house despite all the major leaders urging house members to pa*s it.This shows all politics are local.The reason for failure of this bill is its not that popular with people - opinion polls on the original bailout plan showed majority of people didnt like it and wanted to some changes, while the current bailout bill is different from it - still many of house reps are wary to vote in favor of it.Especially the reps who are up for tough election this November.They are concerned about their election and dont give a damn to their leader.I think it would be same for EB issues - we need to continue to lobby with congressmen and if possible push our EB only aspects in some bill (live visa recapture) because once our issues are combined with general immigration issue we will get run over for sure either by anti-immigrants or people like Durbin.

    The next president might set his/her broad immigration policies but as always devil is in details and these details are set by congress.Also if you observe our opponent organizations and the way they concentrate more on congressional elections rather than presidential elections - it becomes apparent that from EB (and other) immigration laws point of view there may not be much change in impact whether Obama or McCain is president.From their broad immigration policies I am sure either Obama or McCain will sign of any bill that favor more GC numbers (or recaptured EB visas) for EB immigrants.Of course it can get complicated with amendments from likes of Durbin but based on the merit of our issue, I think more congressmen would be voting in favor of our measures.The key is getting our measures pushed into any relevant bills.

  • Person came here on F-1.OPT expired May 2002.His h-1b was approved with a starting validity date of December 2002.

    He gets an rfe to give I-20 and prove status.

    Now: he had an I-94 card from F-1 with duration of stay.Therefore; he is not accruing unlawful presence.However; he was out of status from May 2002 to December 2002.About 7 months.At first glance; he is not eligible to get 485 approved.

    However; in response it will say that there is a grace period of 60 days from end of OPT which will allow him valid status until middle of July.Therefore; from middle of july until h-1b approval he was out of status.By our calculations he was out of status for about 165 days from the end of the 60 day grace period until h-1b approval.

    Now; since he only has a buffer of 15 days remaining; uscis could go from 2002- until 2005 when he filed 485 to see if they can get 15 days of out of status and deny his 485.

    Big problem for him is that he used ac21 and is self employed and not on H-1b anymore.If USCIS should deny his 485; he can't re-file because he is not in non immigrant status and even if he was; the visa dates are unavailable and he would not be able to get cooperation from old employer to re-file 485 anyways because they wouldn't cooperate.He wouldn't be able to get labor substitution because that is gone now.

    If they should deny his 485 then he has to get an h-1b approval for the remainder of his six years; he won't get an I-94 card because he isn't in non immigrant status; he would have to go for visa stamping and then start all over again.

    Not a good situation all around for him.

    I think nowadays you can get great deals in suwanee area, but in alpharetta area (ATLANTA) which is couple of exits towards the city on 400 highway..are still selling for 400K..I am talking about 3000 sq ft, houses..I got a quote for 420K with basement 3070 sqft..with decent upgrades...
    and these homes are closely built compared to the ones in suwanee area..

    The homes prices never came down in these areas!!

    my only problem is Work contracts.

    How am I supposed to get contracts of all clients.
    My employer doesnt share saying its private and confidential..I worked for a top 5 Indian IT in the past..no way I can get those details..duh :confused:

    You need not provide the contracts.Only they need to know is name of the employer.If you talk about the Contracts they can question you about the premises of the permanent job being offered by GC company.If this contracts were needed they should have asked at the I-140 level.May be when you respond you need to tell them I am not working based upon the contracts and I am an employee of the company.

  • I am currently pursuing some initial draft plans with some legal representation, so that a sweeping case may be filed to end this unfair practice.We need to plug this EB3-to-EB2 looph*le, if there is any chance to be had for filers who have originally been EB2.

    More than any other initiative, the removal of just this one unfair provision will greatly aid all original EB2 filers.Else, it can be clearly deduced that the ma*sively backlogged EB3 filers will flock over to EB2 and backlog it by 8 years or more.

    I also want to make this issue an action item for all EB2 folks volunteering for IV activities.

    What you're suggesting is make it even more difficult for anyone to change jobs (then it already is)...

    Don't get too comfy with your EAD card, god forbid you might just get a RFE your AOS can get rejected, then you'll realize why your PD should be portable :D

    North West Frontier Province, the Punjab and Sind.The men and

    If Pakistanis wish to revel in the inglorious misdeeds of

    sang a now-famous verse which told him of the elevation and

    Prithviraj shot his arrow through Ghori.

    Prithviraj is regularly subjected to indignity in the land where

    learned that there was a grand mausoleum over the tomb of Sultan

    Charities are sweet things, but Gary D.Ba*s wants them to get rough and tumble when it comes to dealing with government.

    In his new book, "Seen But Not Heard: Strengthening Nonprofit Advocacy," Ba*s and three co-authors argue that charities need to lobby more often and more effectively."Democracy would be better off," said Ba*s, executive director of OMB Watch, a nonprofit group that pushes for government accountability.

    Most people -- and, clearly, most charities -- think of lobbyists as corporate frontmen trying to grab taxpayer largesse for themselves.They also consider lobbying kind of dirty, given the criminality of infamous lobbyists such as the now-imprisoned Jack Abramoff.

    But lobbyists come in all shapes and sizes, including the charitable sort.Ba*s's book, which is part of a larger effort called the Strengthening Nonprofit Advocacy Project, or SNAP, is a useful reminder of that.

    Ba*s has been trying to convince charities for years that they should not be afraid to lobby.He and others, including the Center for Lobbying in the Public Interest, have even devised ways to ease -- or at least simplify -- the limitations now imposed on charities so they can press their causes more aggressively.

    That's right, they are lobbying to be allowed to lobby more.

    Conservative lawmakers and a few campaign-finance scholars don't like the idea.They worry that, among other things, the ability of charities to keep their donors anonymous could lead to huge and largely untraceable infusions of cash into elections, all under the guise of lobbying.

    And please, call it advocacy.Charities don't like to use the "L" word.Only a third of nonprofits polled recently owned up to "lobbying" two or more times a month.But when asked if they "advocate," closer to half admitted to that.

    Many nonprofits also are unsure how much lobbying the law permits them to do.Only 72 percent even knew that they could support or oppose federal legislation.(They can, up to a point.)

    Ba*s's biggest problem is convincing charities that they not only can make their case to government, but that they really ought to do so .In effect, he needs to convince his fellow do-gooders that lobbying is not so bad.

    "Nonprofit lobbyists have been involved in nearly every major public policy accomplishment in this country -- from civil rights to environmental protection to health care," Ba*s said in an e-mail."Tens of thousands of lives have been saved by pa*sing laws that improve car safety and reduce drunk driving."

    "In other words, nonprofit lobbying is an honorable tradition," he added, "and not just the ugly Abramoff side" of the profession.

    Convincing charities of that, however, will not be a snap.
